1. Application and Water Service

I/We hereby apply for water service at the above premises and agree to use and pay for water in accordance with rates, rules, and regulations established by the City Council of the City of Sonoma under its authority pursuant to Article XIII D of the California Constitution (Proposition 218) and the City of Sonoma Municipal Code. I/We understand that failure to comply with these rules, emergency water restrictions, backflow prevention requirements, or failure to pay the required deposit or monthly bills may result in termination of service. I/We represent and warrant that I am authorized to sign this application and declare under penalty of perjury under the laws of the State of California that all information provided is true, correct, and complete to the best of my/our knowledge.

2. Water Turn-On and Liability Waiver

I/We request the City of Sonoma to turn on water at the above service address and understand that if water-using appliances are not fully closed, or if any leaks exist, the premises may suffer water damage. I/We accept full responsibility for any damage resulting from water service activation and agree to inspect all water-using appliances and plumbing systems before requesting service turn-on. I/We agree to indemnify, defend, and hold harmless the City of Sonoma, its officers, agents, and employees from any and all losses, liabilities, costs, claims, demands, suits, or damages (including attorney's fees) arising directly or indirectly from the water service activation, except where such liability arises from the sole active negligence or willful misconduct of the City.

3. Service Deposit and Fees

I/We understand that a $150 refundable, non-interest bearing water deposit and a $27 non-refundable Start of Service Fee will be added to the first water bill. The deposit will be credited to the account after two years, provided there are no delinquencies (bills unpaid after 39 days past due), returned checks, or water shutoffs. Upon termination of service, a $27 Stop of Service Fee and the original deposit (if not previously applied) will be applied to the final bill. If moving to a new service address within the City of Sonoma, a new account will be opened, and a new deposit may be required unless the applicant qualifies for an exemption. I/We also understand that a late payment penalty of $27 applies to bills unpaid after 39 days. If payment is not received within 60 days of billing date, upon notice, water service will be disconnected and a water service turn off fee of $114 will apply. Water service will be reconnected upon payment in full of any amounts owed including the water service turn off fee.

4. Cancellation of Services

I/We understand that it is my/our responsibility to notify the City of Sonoma when water service should be discontinued at the above service address. I/We will remain responsible for all service charges until a Stop Service Form is filed and accepted by the City. Charges will continue to accumulate until the City accepts such notification.
